Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, software, platforms, products, communications, and services provided by B365 Solutions LLC ("B365 Solutions," "B365," "we," "us," or "our").
By accessing our website, creating an account, purchasing or using our services, submitting information through our forms, or otherwise using B365 Solutions services, you agree to these Terms.
If you are using B365 Solutions on behalf of a business or organization, you represent that you have authority to accept these Terms on its behalf.
1. B365 Solutions Services
B365 Solutions provides business technology and digital services that may include:
- Customer relationship management software and tools
- Website design, development, hosting, and management
- Business automation and workflow services
- Customer communication tools
- SMS and MMS messaging
- Email communication and marketing tools
- Phone and calling services
- Lead and contact management
- Appointment scheduling
- Forms and surveys
- Online payments and invoicing
- Reputation and review management
- Marketing services
- Artificial intelligence powered tools and automation
- Analytics and reporting
- Integrations with third party platforms
- Other business technology, consulting, and related services
Specific features available to a customer may depend on the service or subscription purchased.
2. Accounts
Certain services require an account. You are responsible for maintaining accurate account information, protecting your login credentials, and all activity occurring through your account. You may not provide unauthorized access to your account or use another person's account without permission. You must notify B365 Solutions promptly if you believe your account has been accessed without authorization.
3. Customer Responsibilities
You are responsible for your use of B365 Solutions and for ensuring that your business activities comply with applicable laws and regulations. If you use B365 Solutions to communicate with your customers or contacts, you are responsible for obtaining all legally required permissions and consent before sending communications. This includes compliance with laws and industry requirements applicable to email, telephone calls, SMS, MMS, automated communications, advertising, privacy, and data protection.
You may not use B365 Solutions to send spam, unsolicited marketing messages, deceptive communications, unlawful content, or communications to individuals who have not provided legally sufficient consent when consent is required.
4. SMS and MMS Messaging Terms
B365 Solutions may send SMS or MMS messages to individuals who have provided consent to receive them. Messages may include appointment information, account notifications, customer service communications, service updates, reminders, promotional offers, marketing communications, and other information related to B365 Solutions.
Consent to receive marketing text messages is not a condition of purchasing any goods or services. Message frequency varies. Message and data rates may apply.
You may opt out of SMS or MMS communications at any time by replying STOP to a message. After submitting STOP, you may receive a confirmation that you have been unsubscribed. After processing the request, you will no longer receive messages from that messaging program unless you subsequently provide consent again.
If you previously opted out and would like to receive messages again, you may opt in again using an available B365 Solutions signup or consent process. For assistance, reply HELP to a message or contact B365 Solutions at support@b365solutions.com.
Wireless carriers are not responsible for delayed or undelivered messages. Your wireless carrier's messaging and data charges may apply according to your wireless service agreement. SMS consent applies only to the specific sender and messaging program for which consent was provided. Consent is not transferable to another business. Our handling of mobile information and messaging consent is described in our Privacy Policy.
5. Marketing Communications
Where permitted by law and based upon the consent or other lawful basis applicable to the communication, B365 Solutions may communicate with you through email, SMS, MMS, telephone, browser notifications, application notifications, or other communication channels. Marketing communications may include information about B365 Solutions products, services, promotions, offers, educational content, announcements, and related business information.
You may unsubscribe from marketing emails using the unsubscribe link provided in applicable emails. You may opt out of marketing SMS and MMS messages by replying STOP. You may adjust browser or application notification permissions through the applicable browser, device, or application settings.
Certain transactional or service related communications may still be sent when necessary to provide a service you requested, maintain your account, process a transaction, provide security notifications, or comply with legal obligations.
6. Telephone Calls
If you provide a telephone number and provide any consent required by applicable law, B365 Solutions may contact you regarding inquiries, services, appointments, account matters, customer support, or marketing. Depending on the consent provided and applicable law, communications may use automated technology. Providing consent to receive marketing calls or text messages is not a condition of purchasing goods or services where prohibited by law. You may request that B365 Solutions stop marketing calls at any time.
7. Email Communications
B365 Solutions may send transactional, service related, and marketing email communications where permitted by law. Marketing emails will provide an appropriate method to unsubscribe. Unsubscribing from marketing email does not necessarily prevent B365 Solutions from sending transactional or administrative messages relating to an active account, purchase, security issue, or requested service.
8. Customer Data and CRM Services
Certain B365 Solutions services allow business customers to collect, store, manage, or process information concerning their own customers, leads, employees, or other contacts. For this information, the B365 Solutions customer generally determines why the information is collected and how it is used. Customers are responsible for ensuring they have a lawful basis and any required consent to collect, upload, store, process, and communicate with individuals whose information they place into B365 Solutions systems.
Customers may not upload unlawfully obtained contact lists or use B365 Solutions to communicate with purchased lists or individuals without required consent. B365 Solutions may process customer supplied information as necessary to provide, secure, maintain, troubleshoot, and improve the contracted services and as otherwise permitted by applicable law and applicable agreements.
9. Third Party Services and Integrations
B365 Solutions may use or integrate with third party technology providers for services including hosting, communications, telecommunications, payments, analytics, artificial intelligence, customer relationship management, authentication, scheduling, email delivery, and other business functions. Your use of certain integrated services may also be subject to the applicable provider's terms and policies.
B365 Solutions is not responsible for outages, service interruptions, policy changes, account restrictions, or actions caused by independent third party providers outside B365 Solutions' reasonable control.
10. Payments and Subscriptions
Certain B365 Solutions services require payment. Prices, billing schedules, setup fees, subscription periods, and other payment terms will be disclosed when you purchase a service or in an applicable proposal, invoice, service agreement, order form, or checkout page. Recurring subscriptions may automatically renew according to the billing terms presented at purchase unless canceled.
You authorize B365 Solutions and its payment providers to charge the payment method you provide for applicable fees, recurring charges, taxes, and other authorized amounts. Unless otherwise stated in writing, fees already earned for services performed are nonrefundable to the extent permitted by law. Cancellation of a recurring service prevents future renewal charges but does not automatically entitle the customer to a refund for a billing period that has already begun.
Any service specific agreement between B365 Solutions and a customer may contain additional payment, cancellation, refund, ownership, or termination provisions. Where a signed service agreement directly conflicts with these general Terms concerning that purchased service, the applicable service agreement will control.
11. Affiliate and Partner Disclosure
B365 Solutions may participate in affiliate, referral, reseller, or partner programs. Some links, recommendations, products, or services displayed through B365 Solutions websites or communications may be affiliate or partner links. B365 Solutions may receive compensation, commissions, credits, referral fees, or other benefits when a user purchases or signs up through certain links. This generally does not increase the price paid by the customer unless specifically disclosed. Affiliate or partner relationships do not permit B365 Solutions to sell or transfer SMS consent or mobile opt in information for another company's marketing.
12. Intellectual Property
Unless otherwise stated in a separate agreement, B365 Solutions owns or licenses the software, website elements, systems, designs, branding, documentation, processes, and other intellectual property used to provide B365 Solutions services. Customers retain ownership of content and intellectual property they provide to B365 Solutions, subject to any licenses reasonably necessary for B365 Solutions to perform the requested services. Project specific ownership rights may be further defined in proposals, contracts, statements of work, or other written agreements.
13. Acceptable Use
You may not use B365 Solutions to:
- Violate any applicable law or regulation
- Send spam or unlawful communications
- Harass, threaten, defraud, or impersonate another person
- Distribute malware or malicious software
- Attempt unauthorized access to systems or accounts
- Interfere with platform security or operation
- Collect information unlawfully
- Send messages without required consent
- Upload purchased, scraped, stolen, or unlawfully obtained contact lists for prohibited communications
- Engage in deceptive marketing practices
- Infringe intellectual property rights
- Use the services for illegal or fraudulent activities
B365 Solutions may suspend or terminate access when reasonably necessary to protect users, telecommunications networks, service providers, B365 Solutions, or the public, or to comply with applicable law or provider requirements.
14. Artificial Intelligence and Automated Services
Some B365 Solutions services may use artificial intelligence or automated technology. AI generated content and automated actions may contain errors and should be reviewed before being relied upon for important business, financial, legal, medical, or other consequential decisions. Customers remain responsible for reviewing and approving the communications, content, workflows, and actions deployed for their business.
15. Availability and Changes
B365 Solutions works to maintain reliable services but does not guarantee uninterrupted or error free availability. Features may occasionally be modified, replaced, suspended, or discontinued due to technical requirements, security concerns, regulatory requirements, third party platform changes, or product improvements.
16. Disclaimer of Warranties
To the fullest extent permitted by law, B365 Solutions services are provided on an "as is" and "as available" basis. B365 Solutions does not guarantee specific business results, revenue, search engine rankings, lead volume, advertising performance, message delivery, customer acquisition, platform availability, or other particular outcomes unless expressly guaranteed in a separate written agreement.
17. Limitation of Liability
To the fullest extent permitted by applicable law, B365 Solutions will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, loss of data, lost business opportunities, or business interruption arising from use of the services.
To the fullest extent permitted by law, B365 Solutions' aggregate liability relating to a particular paid service will not exceed the amount paid by the customer to B365 Solutions for that service during the six months immediately preceding the event giving rise to the claim. Nothing in these Terms limits liability where such limitation is prohibited by law.
18. Indemnification
To the extent permitted by law, business customers agree to indemnify and hold B365 Solutions harmless from claims, damages, liabilities, penalties, and reasonable expenses resulting from the customer's unlawful use of the services, violation of these Terms, violation of applicable communication or privacy laws, infringement of third party rights, or communications sent using customer supplied data without required consent.
19. Termination
You may discontinue use of B365 Solutions subject to applicable subscription, contract, and billing obligations. B365 Solutions may suspend or terminate services for material violations of these Terms, unlawful activity, nonpayment, abuse, security threats, messaging violations, telecommunications carrier requirements, or conduct that could reasonably harm B365 Solutions, its infrastructure, its providers, or other users.
20. Privacy
Use of B365 Solutions is also governed by our Privacy Policy. Requests concerning deletion of personal information may be submitted using our Data Deletion page or by contacting support@b365solutions.com.
21. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles, except where applicable federal law or another jurisdiction's mandatory consumer protection laws require otherwise.
22. Changes to These Terms
B365 Solutions may update these Terms periodically to reflect changes in services, technology, legal requirements, or business practices. The "Last Updated" date will identify the most recent revision. Continued use of the services after an updated version becomes effective constitutes acceptance of the updated Terms to the extent permitted by law.
